Key Definitions
To clarify, the following terms are used throughout this agreement:
- Affiliate: Any individual or entity accepted into the Program and responsible for referring customers to Betway. For simplicity, “you” refers to Affiliates in this document.
- Affiliate Banner Tag/Account: A unique tracking mechanism provided by Betway to monitor your referred customers and related activities.
- Affiliate Sites: Websites or platforms you own or operate to generate referrals. This includes mobile and tablet versions of websites.
- Betway Marks: Trademarks or logos owned by Betway or its affiliates, including Betway Casino and Betway Sports.
- Confidential Information: Any proprietary information shared by Betway, such as reports, customer data, or payment records.
Joining the Program
To become an Affiliate, you must meet the following requirements:
- Provide accurate and up-to-date information during registration and update your details when necessary.
- Be at least 18 years of age and legally capable of entering into binding agreements.
- If applying on behalf of a company, ensure you have the authority to bind the organization to this agreement.
Failure to comply with these requirements or notify Betway of changes in your eligibility may result in immediate termination of your participation.
Marketing and Approved Activities
Betway provides Affiliates with a variety of marketing materials, including banners, text links, and promotional graphics, to assist in their campaigns. Affiliates are granted a non-exclusive license to use these materials solely for driving traffic to Betway Sites.
Responsibilities:
- Use only the most up-to-date marketing materials provided by Betway.
- Avoid modifying or altering any materials without prior written approval.
- Ensure your marketing activities comply with the laws and regulations of your target region.
Betway retains the right to review, update, or withdraw marketing materials at its discretion. Non-compliance may result in suspension or termination from the Program.
Commission Structure and Payments
Earnings Model:
Affiliates can earn commissions based on two models:
- Revenue Share: Earnings range from 25% to 40%, depending on the number of new customers referred within a month.
- CPA (Cost Per Acquisition): A one-time payment for each referred customer who meets predefined criteria.
Payment Process:
Payments are processed monthly, with minimum thresholds of €100 for e-wallets and €300 for bank transfers. Affiliates are responsible for ensuring their payment details are accurate and up-to-date to avoid delays.
Betway reserves the right to adjust commission rates, introduce special promotions, or withhold payments in cases of fraudulent activity or non-compliance.
Termination and Compliance
Grounds for Termination:
Betway may terminate your participation for reasons including:
- Breach of these Terms or applicable laws.
- Engagement in fraudulent or deceptive activities.
- Actions that harm Betway’s reputation or violate ethical standards.
Post-Termination Obligations:
Upon termination, you must immediately cease using Betway’s marketing materials and disable all links to Betway Sites. All rights granted under this agreement will be revoked, and Betway may withhold any unpaid commissions if fraudulent or non-compliant behavior is detected.
Compliance Standards:
Affiliates are required to comply with laws governing online marketing, data protection, and anti-money laundering regulations. Failure to do so may result in immediate removal from the Program and possible legal action.
General Obligations
As a Betway Partner, you are expected to:
- Uphold the highest standards of ethical marketing practices.
- Avoid engaging in activities that could mislead, confuse, or harm users.
- Prevent the use of prohibited sites or channels for promotions.
Additionally, you are prohibited from using any intellectual property owned by Betway beyond the scope of the Program. Violations, including domain squatting or brand bidding, will result in penalties and potential removal from the Program.
Final Provisions
These Terms represent the entire agreement between you and Betway Partners and supersede any prior agreements or understandings. Any disputes arising from this agreement shall be resolved under the jurisdiction of Maltese courts.
